1. The Service

Apes Alpha provides quantitative research tools, market data visualizations, historical statistics, screeners, and related analytics for informational and educational purposes. Features, data coverage, and availability may change, be suspended, or be discontinued at any time without notice.

2. Not financial advice

The Service does not provide investment, financial, legal, tax, or accounting advice, and nothing on the Service is a recommendation to buy, sell, or hold any security or to pursue any investment strategy. All content is general in nature and does not account for your personal circumstances, objectives, or risk tolerance.

Historical statistics and backtested results describe the past and are not a forecast or a guarantee of future performance. Trading and investing involve substantial risk, including the possible loss of principal. You are solely responsible for your own decisions and should consult a licensed professional before acting on any information you find here.

Conflicts of interest. The operator of this site may hold, buy, or sell positions in securities that are discussed, referenced, or tracked by strategies described on the Service, before, during, or after related content is published or updated.

3. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service you represent that you meet these requirements and that your use complies with all laws that apply to you.

4. Accounts

• You must provide accurate information when registering and keep it current.
• You are responsible for all activity under your account and for keeping your password confidential.
• Accounts are for a single user. Do not share your login or let others access the Service through it.
• Notify us promptly at ape@apesalpha.com of any unauthorized use.

5. Subscriptions & billing

Some features require a paid subscription. Pricing and plan features are shown at checkout and on our pricing page. Payments are processed by Whop; we do not receive or store your card details. By subscribing you authorize us and Whop to charge your payment method for the applicable fees.

• Subscriptions renew automatically at the end of each billing period at the then-current rate until cancelled.
• Fees are stated in U.S. dollars and are exclusive of any taxes, which you are responsible for where applicable.
• We may change subscription pricing; changes apply to the next billing period after we give notice.
• If a payment fails, we may suspend or downgrade access until the balance is resolved.

6. Cancellation & refunds

You may cancel at any time from your account settings or by emailing us. Cancellation stops future renewals; your access continues until the end of the current paid period. Except where required by law, payments are non-refundable and we do not provide prorated refunds for partial periods. If you believe you were billed in error, contact us within 30 days of the charge.

7. Acceptable use

You agree not to:

• scrape, crawl, harvest, or bulk-download data or content except through features we expressly provide;
• resell, redistribute, sublicense, or publicly display the data or content, or use it to build or train a competing product or dataset;
• reverse engineer, decompile, or attempt to derive source code or underlying models;
• circumvent access controls, rate limits, paywalls, or usage restrictions;
• share account credentials or exceed the seat count you paid for;
• interfere with, overload, or disrupt the Service or its infrastructure;
• use the Service for anything unlawful or to infringe the rights of others.

What you may not post. The Service carries content written by its members. You agree not to post, upload, or submit anything that:

• is unlawful, fraudulent, or deliberately deceptive, including any attempt to manipulate a market — pump-and-dump schemes, coordinated ramping of a security, posting a call you intend to trade against, or promoting a security in exchange for payment or other consideration without disclosing it;
• impersonates any person, company, or public figure, or falsely suggests that an account is operated, endorsed, or verified by someone it is not;
• harasses, threatens, bullies, or incites violence against anyone, or attacks people on the basis of a protected characteristic;
• publishes another person’s private information — home address, phone number, email address, financial or identity documents — without their consent;
• is spam, or is posted in bulk or by automated means, or exists to inflate engagement: fake or purchased follows, likes, comments, or views, or coordinated activity intended to move what the Service ranks or recommends;
• infringes anyone’s copyright, trademark, or other rights;
• contains malware, phishing, or links intended to defraud or compromise a reader;
• is sexual content involving minors, or any other content prohibited by law.

8. Intellectual property

The Service, including its software, design, text, charts, compilations, and original analytics, is owned by us or our licensors and is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own personal or internal business use. All rights not expressly granted are reserved.

9. User content

“User Content” means anything you post, upload, or submit to the Service, including entries, comments, profile information, and links. You retain any rights you hold in your User Content.

By submitting User Content you grant us a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, fully sublicensable and transferable license to host, store, reproduce, adapt and reformat, publish, publicly display, distribute, and otherwise use your User Content in connection with operating, promoting, and improving the Service and our other products — including distribution through application programming interfaces, data feeds, and licensed or commercial datasets provided to third parties. No compensation is payable to you in respect of any such use.

Aggregated and derived data. We may create, publish, sell, and license aggregated, derived, statistical, or anonymised data based on User Content and on use of the Service. We own that derived data.

Public by default. Entries, profiles, and comments are public. They may be indexed by search engines, shared by others, and included in the data described above.

Deletion. You may delete your User Content. Deletion removes it from public view on the Service. Copies may persist in backups, caches, and in data already distributed or licensed to third parties. Where you delete a published call, your profile may show that a call was deleted, and how many have been, without showing what it was — a record that a position was withdrawn is part of what makes the rest of a profile meaningful.

Your warranties. You confirm that you have the rights necessary to post what you post, and that it does not infringe the rights of any person or breach any law.

Our discretion. We may remove, refuse, or restrict any User Content at any time, for any reason, without notice. We are under no obligation to monitor User Content.

10. Moderation, enforcement, and copyright complaints

What we may do. We may, at our sole discretion and with or without notice: remove or refuse any User Content; label or annotate it; limit how widely it is distributed, including withholding it from the feed, search, recommendations, or rankings; restrict a feature for an account; and suspend or terminate an account. We may do any of these because content breaches these Terms, because it risks harm to readers or to the Service, or because we are required to. We may also preserve and disclose content and account records where we believe in good faith that the law requires it, or that doing so is necessary to protect our rights, our users, or the public.

No obligation to monitor, and no guarantee of reach. We are not obliged to review User Content, and we do not endorse it. Nothing in these Terms requires us to distribute, rank, or recommend anything: what the Service shows, to whom, and in what order is at our discretion and may change at any time. Content we leave up is not thereby approved.

Repeat infringers. We terminate, in appropriate circumstances, the accounts of members who repeatedly infringe the rights of others.

Copyright complaints. If you believe content on the Service infringes your copyright, send a notice to ape@apesalpha.com with the subject line “Copyright”, containing: your physical or electronic signature; identification of the work you say is infringed; the address of the content you want removed; your address, telephone number, and email address; a statement that you believe in good faith that the use is not authorised by the owner, its agent, or the law; and a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorised to act on the owner’s behalf. We will respond to complete notices, and the member who posted the content may submit a counter-notice to the same address.

11. Third-party data & services

The Service incorporates data from third-party and public sources (for example, exchange and index prices, regulatory filings, and volatility data). That data may be delayed, incomplete, adjusted, restated, or inaccurate, and is provided subject to the terms of its originating sources. We do not warrant the accuracy, completeness, or timeliness of any data and are not liable for errors in it. The Service also relies on third-party providers (such as Whop for payments and our hosting and email providers) whose own terms and policies apply.

12. Disclaimers

THE SERVICE AND ALL CONTENT AND DATA ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ACCURATE, OR ERROR-FREE. YOU USE THE SERVICE AT YOUR OWN RISK.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APES ALPHA AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR TRADING OR INVESTMENT LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IN ANY 12-MONTH PERIOD WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE DURING THAT PERIOD OR (B) USD $100.

14. Indemnification

You agree to indemnify and hold harmless Algorithm Services LLC, its members, and its employees from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

15. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or to protect the Service or other users. You may stop using the Service at any time. Sections that by their nature should survive termination (including Sections 2, 8, 9, 10, 11, 12, 13, 14, and 17) will survive.

16. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

17. Governing law

These Terms are governed by the laws of the United States and the State of New York, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the state and federal courts located in New York for any dispute, other than one that may be brought in small-claims court.
